A raíz de la retirada del Reino Unido de la Unión Europea, la Dirección General de Migraciones y la Dirección General de la Policía, formalizaron la instrucción que fue publicada en el BOE bajo el Nº 184 de 4 de julio de 2020 por la que se desarrolla la solicitud de la nueva tarjeta de residencia para estos ciudadanos estableciendo tres grupos:

• Quienes posean la tarjeta verde (certificado de residencia de la UE)
• Los familiares de los ciudadanos Británicos.
• Aquellos ciudadanos del Reino Unido y sus familiares que quieran desplazar su residencia al territorio español, o que viviendo aquí nunca han tramita el Certificado de la Unión

En cuanto a los dos primeros grupos, deberán cambiar su certificado de la Unión por su correspondiente tarjeta de residencia directamente en la Comisaría de policía a la cual corresponda.

En cuanto al tercer grupo, para quienes establezcan su residencia habitual en España a partir del 31 de diciembre o quienes vivan ya aquí pero no dispongan del certificado, deberán realizar una solicitud previa a la Oficina de Extranjería que le corresponda según donde pretenda radicar su domicilio, o donde ya se encuentren empadronados, se tendrá que acreditar todos los requisitos que exige la normativa para tramitar el Certificado de la Unión. a partir del 1 de enero quienes presenten estas solicitudes tendrán la condición de un ciudadano de tercer país por lo que le será de aplicación el régimen general.
